Polivid Terms of Use

1. Introduction
Welcome to Polivid, a trading name of Edgmont Ltd, a company registered in England and Wales. These Terms of Use govern your access to and use of https://polivid.co.uk (the “Website”) and any services provided by Polivid, including but not limited to video editing, creative content production and campaign media services. These Terms form a legally binding agreement between Polivid (“we”, “our”, “us”) and you, the user (“you”, “your”, “Client”).
By accessing or using our Website and services, you confirm that you have read, understood and agreed to these Terms. If you do not agree to these Terms, you must immediately cease using our services. If you are acting on behalf of an organisation, you confirm that you have the legal authority to bind that organisation to these Terms.
2. Services and Subscription Model
Polivid provides professional on-demand video editing and creative content production services tailored for political campaigns, advocacy groups and public engagement initiatives. Our services are offered on a subscription basis, with different service tiers available. The details of each subscription, including features, turnaround times and revision policies are provided on our Website.
Clients may submit unlimited content requests, but work will be completed in line with their subscription plan’s fair-use policy. Each plan outlines specific processing times, priority levels and revision limits, which ensure equitable access to our services. Clients have the flexibility to pause or cancel their subscription, with changes becoming effective at the start of the next billing cycle.
3. Ownership of Content and Intellectual Property
Upon completion of a project, Polivid grants full intellectual property rights to the final video or creative content to the Client, subject to any third-party licensing restrictions for assets used (e.g. stock music, footage).
If a Client supplies assets, they confirm they own or have licensed those assets. Clients must ensure they have the necessary legal rights for any provided content.
Polivid retains the right to showcase completed work in its portfolio, website or marketing materials, unless the Client explicitly requests otherwise in writing before the project begins.
4. Political Campaign Compliance
Clients using Polivid’s services for political advertising, election campaigns or advocacy work are solely responsible for ensuring that all materials comply with UK electoral laws and advertising regulations. This includes compliance with:
• The Political Parties, Elections and Referendums Act 2000 (PPERA)
• Spending limits and reporting requirements under the Electoral Commission
• Mandatory imprints and transparency requirements on political advertisements
Polivid provides invoices for campaign finance record-keeping but is not liable for non-compliance with electoral laws. Clients must ensure that all required disclosures and imprints are included in their campaign materials.
Polivid reserves the right to refuse projects that:
• Violate UK election laws
• Contain misleading, defamatory or unethical content
• Are inconsistent with our internal ethical guidelines
5. Payments, Billing and Refunds
Polivid operates on a monthly subscription basis, with payments processed in advance via Stripe. Clients must ensure valid payment details are provided.
Clients may pause or cancel their subscription at any time, with changes taking effect at the next billing cycle. No partial refunds are provided for unused subscription time.
Refund requests are considered on a case-by-case basis. If a refund is granted within the first month of service, all work delivered remains the property of Polivid and may not be used by the Client. A 25% processing fee may apply.
Once campaign materials created by Polivid are publicly used, refunds will not be granted, even if a refund request is within the first month of service.
6. Due Diligence, Compliance & Right to Refuse Service
6.1 Client Responsibility for Compliance
By using Polivid’s services, Clients confirm that they:
Are not listed on any UK, EU or US financial sanctions lists.
Are not acting on behalf of a sanctioned individual, government or organisation.
Are not using Polivid’s services for unlawful purposes, including but not limited to:
• Money laundering or financial crime.
• The production of misinformation, fraudulent content, or misleading advertising.
• Any activity that would violate UK electoral laws, including foreign-funded election interference.
6.2 Right to Refuse or Terminate Services
Polivid reserves the right to refuse, suspend, or terminate services without prior notice if:
• A Client fails identity verification or raises reasonable compliance concerns.
• A Client provides misleading information about their identity or campaign funding.
• Polivid receives credible evidence that the Client is involved in illegal or unethical activities.
• The Client’s activities are likely to breach UK, EU or international regulatory frameworks.
6.3 Reporting Obligations
Polivid may be required to report certain transactions or activities to regulatory authorities if there is evidence of financial crime, terrorism financing or other unlawful activities.
7. Limitation of Liability
Polivid does not guarantee specific campaign outcomes, audience engagement or election results.
While we strive for maximum uptime, we are not liable for losses arising from service delays, downtime or unforeseen disruptions.
Clients agree to indemnify and hold Polivid harmless against any claims resulting from:
• Non-compliance with electoral laws
• Copyright infringement from Client-supplied materials
• Defamatory or misleading content created using our services
Polivid’s total liability under any circumstances shall not exceed the total fees paid by the Client in the last 3 months.
8. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England & Wales. Any disputes shall be resolved exclusively in the courts of London.
